What is premises liability law?
Premise liability law encompasses all types of negligence cases where an accident or injury happens on someone else’s property. This can be anywhere – the grocery store, sidewalk, acquaintance’s house, mall, restaurants, office building and more. The most common premise liability case is a slip and fall on a slippery surface or a trip and fall on an uneven surface.
When is a property owner responsible for injuries?
Colorado premises liability law and Colorado negligence law in this area has been put into a single statute or law on the books. Colorado Revised Statute 13-21-115 provides that injured individuals may be compensated if the landowner, which can mean an agent or person in control of the property or conducting activity on the property, unreasonably fail to exercise reasonable care to protect against dangers for which they knew or should have known. Basically, when a "property owner," including businesses, as defined in the statute has a dangerous condition on their property and fails to take necessary precautions to keep you safe, they should be responsible for the harm.
What should I do if I have been injured on someone’s property?
- Take photos. Preserving evidence can help prove your case.
- File an accident report if you are able to before leaving. Most retailers, offices etc. have a standard procedure they are supposed to follow.
- Get witnesses contact information.
- Get medical attention. Sometimes a significant injury to the back and neck or a traumatic brain injury isn’t immediately apparent. Delays in medical care can worsen a condition and hurt your case.
